『明镜公案』 真实性与法律性研究
『명경공안（明镜公案）』은 전체 명칭이 『신각명공신단명경공안(新刻名公神断明镜公 案）』인데 명나라 갈천민（葛天民）, 오패천（吴沛泉）이 편찬한 것으로 제사체（诸司体, 공문나 조서와 같은 문체）명나라 공안소설（公案小说）의 대표작 중의 하나이다. 제사체 공 안소설을 “법가의 서적인 듯 아닌 듯, 소설인 듯 아닌 듯하다(似法家书非法家书，似小说亦 非小说)”고 생각해서 이런 종류의 공안소설을 소설의 말단으로 분류한 학자도 있었으나 실제 적으로는 “제사체” 공안소설의 여러 사건 중에 당시 사회의 실재적인 인물과 사실에서 따온 이야기가 많다. 『명경공안』도 그런 경우에 속한다. 진실성은 『명경공안』 등과 같은 제사 체 명나라 공안소설의 아주 특수한 특징이 되었고, 사건 판결에 필요한 고소장과 판결문 등은 소설 서사의 주요한 구성요소가 됐다. 『명경공안』은 문학·예술 분야에서 출중하지 않지만 명나라 때 공안소설의 중요한 대표작으로 큰 영향력 있었으며 소설의 내용에는 풍부한 명나 라 법률 지식과 백성의 생활과 밀접한 민사·형사 사건을 포함해서 법률을 전달하는 데 큰 의의가 있다.
“Mingjing Koan” Social Research
“Mingjing Goan” full name “Newly engraved MingGong ShenDuan Mingjing Koan”, Compiled by Ge Tianmin and Wu Peiquan , It is one of the masterpieces of ZhuSi style Koan novels in the Ming Dynasty. Some scholars thought that this kind of Koan novel “Like a family book but not a family book, like a novel but not a novel”, It is classified as the last of the novels. Although “Mingjing Koan” is not outstanding in literature and art, it has strong social authenticity and legality. First of all, it has strong authenticity, many stories are taken from real people and things in society at that time, and make adverbs, pleadings, and judgments as the main components of the narrative.This is also one of the important characteristics of ZhuSi style novels in the Ming Dynasty. Secondly, it has strong legality, contains a wealth of knowledge of Ming Dynasty laws, the subject matter involves civil and criminal cases closely related to people's lives, It is great significance in transmitting the law. This is also one of the reasons why it became the masterpiece of the Koan novels in the Ming Dynasty and had an important influence.
